Serving Active Duty Service Members and Veterans Harmed by Medical Malpractice in Albuquerque, New Mexico

Our active duty and retired military deserve the absolute best we can give them, especially when it comes to health care. Unfortunately, substandard medical care occurs everywhere, and military and veterans’ hospitals are certainly no exception. Although the same rules don’t always apply to military members that apply to civilians, if you are harmed by medical malpractice, there is something you can do about it.

Attorney Peter Bertling worked for 30 years as a lawyer retained by insurance companies and doctors to defend them when they get sued for malpractice. He learned everything there is to know about how doctors and hospitals defend medical malpractice cases, and he uses that knowledge now to help active-duty military and veterans when they have been harmed by medical malpractice. Call the Bertling Law Group at 844-295-7558 if you or your loved harm were hurt by medical negligence or inexcusable mistakes at a military or VA hospital or clinic in Albuquerque.

Military Hospitals in Albuquerque

The 377th Medical Group provides comprehensive health care to active duty service members at Kirtland Air Force Base in Albuquerque. Services offered here include Primary Care and Family Medicine; Preventive Care, including Alcohol and Drug Abuse Prevention and Treatment and Immunizations; Urgent & Emergency Care; Mental Health & Substance Abuse, including Behavioral Health and Drug Demand Reduction; Lab Tests & Radiology; Specialty Care, including Chiropractic and Physical Therapy; Case Management, Dental; Pharmacy; Vision and Optometry; Women’s Health & Pregnancy; and Children’s Health and Pediatrics.

A new law allows military service members or their families to file a claim for personal injury or death incident to service that was caused by the medical malpractice of a Department of Defense health care provider. This procedure involves filing Standard Form 95 with your service branch and using that form to show how the doctor or hospital breached their duty to provide adequate care and how you were harmed thereby. There’s no litigation or discovery and no right to appeal or sue in court, so you have to do everything you can to prove your case on Standard Form 95. An attorney with the Bertling Law Group can make sure you put your best foot forward and are in the best position for a successful outcome in this new legal process.

VA Hospitals and Clinics in Albuquerque

The Raymond G. Murphy Department of Veterans Affairs Medical Center serves veterans in Albuquerque, providing primary care and specialty health services, including mental health care, recreation and creative arts therapy, treatment for spinal cord injuries and disorders, suicide prevention, women’s health services, and more. Veterans can also receive outpatient treatment at the Northwest Metro VA Clinic in nearby Rio Rancho.

Veterans harmed by misdiagnosis, surgical errors, medication mistakes or other medical malpractice at a VA medical center or clinic can pursue an administrative remedy by filing Standard Form 95 with the VA Regional Counsel. However, if the claim is not satisfactorily resolved within six months, veterans have the right to sue for damages in federal court and recover for their medical bills, pain and suffering, and other legal damages. The Bertling Law Group includes skilled and experienced litigators who are no strangers to the courtroom and can ably represent you in an out-of-court settlement or at trial.

Helping Families Who Lost a Loved One to Suicide

One of the most distressing and alarming forms of medical malpractice, especially among our active duty service members and veterans, is when a psychiatric care provider fails to properly diagnose or treat a patient with mental health issues and fails to take reasonable steps to protect them from suicide. This type of case is of particular concern at the Bertling Law Group, and we devote all our resources toward holding doctors and hospitals accountable for these failures. We have taken on this fight to get justice for your loved one, raise awareness of the issue, and hopefully prevent such needless tragedies in the future.
