Valor is stability, not of legs and arms, but of courage and the soul.

Legal Advocacy for Military Veterans

In return for honorably serving your country, you deserve to receive quality care from VA hospitals, clinics and health care providers. Unfortunately that does not always happen, and you or your loved one may have been injured by the negligence of a VA health care provider.

Bertling Law Group will hold the VA responsible for their negligence and ensure you receive the maximum compensation for your injuries.

Prior to providing patient advocacy, Peter Bertling spent more than three decades defending hospitals, nurses and doctors accused of wrongdoing. He knows how insurance companies and the Federal Government evaluate medical malpractice actions, and what factors they focus on when making a decision to resolve a case or aggressively defend it. Bertling Law Group now uses that insight to help injured patients recover the maximum financial compensation to which they are entitled.

Federal Tort Claims Act permits you to recover from the VA

The Federal Tort Claims Act permits private parties to sue the United States for personal injuries caused by its employees. To file a valid FTCA claim, you must prove the following:

  • That a VA employee injured you.

  • That the VA employee acted within the scope of her or his official duties.

  • That the VA employee acted negligently or wrongfully.

  • That the VA employee’s negligent or wrongful act caused your injury.

You may file an FTCA claim against any employee of the VA, including doctors, nurses, physical therapists, pharmacists, psychologists or any other health care provider employed by the VA who were engaged in job duties when they injured you.

Common medical malpractice claims

A wide range of injuries may be inflicted by a negligent military doctor. Some common types of medical negligence include the following:

  • Misdiagnosis or failure to diagnose

  • Delays in medical diagnosis

  • Negligent prenatal care

  • Birth injuries

  • Medication and prescription errors

  • Surgical negligence and unnecessary surgeries

  • Negligent medical care and mental support resulting in suicide

  • Anesthesia negligence

  • Post-surgical errors and infection

Veteran suicide and the VA

The Veterans’ Health Administration has an obligation to treat the mental health issues of our nation's veterans. Unfortunately, treatment for mental health conditions such as PTSD, depression, anxiety and chronic pain are often significanty delayed or essentially ignored. When that happens your loved one may experience a mental health crisis which results in suicide. Suicide is not a moral failure and can often be prevented with appropriate medical and mental health treatment.
